Motorcycle Rental Agreement

Version 1.0 · Last updated August 1, 2026. This agreement applies to every rental of a Redline Garage motorcycle (currently the Kawasaki Ninja 400 and Ninja 650, each an "Vehicle"). By checking the agreement box during booking and completing payment, the Renter accepts these terms in full.

1. Parties

This agreement is between The Redline Garage ("Owner," "we," "us"), operating as a peer-to-peer motorcycle rental service based in New Jersey, and the individual who submits a booking and completes payment ("Renter," "you"). Only the named Renter is authorized to operate the Vehicle — no additional or substitute riders are permitted without our prior written consent.

2. Eligibility Requirements

  • Valid motorcycle license. A valid Class M endorsement (or equivalent for your state/country) is required. Permit-only riders are not eligible.
  • Minimum age 21. Renters must be at least 21 years old with a minimum of one year of licensed motorcycle riding experience.
  • Valid ID and license verification. Owner may request to see and photograph a valid driver's license/motorcycle endorsement and a form of government ID before releasing the Vehicle. Owner may decline to release the Vehicle if these cannot be verified.

3. Rental Period, Pickup & Return

The rental period begins and ends at the date/time confirmed by Owner following booking. Pickup and return occur by appointment at a location designated by Owner. The Vehicle must be returned with a full tank of fuel — a refueling charge plus a $25 service fee applies if it is not.

Late returns. The Vehicle must be returned at the agreed time. Late returns are billed at 1.5× the daily rate for each additional day or partial day, and may affect availability for the next renter. Repeated or excessive lateness may result in a report to local authorities for unauthorized vehicle retention.

4. Permitted Use

The Vehicle may only be used for lawful, ordinary street riding. The following are strictly prohibited and will void all protection coverage described in Section 6:

  • Track days, closed-course riding, racing, or timed runs of any kind
  • Stunting, wheelies, burnouts, or other reckless maneuvers
  • Off-road, unpaved, or gravel riding
  • Operating the Vehicle while under the influence of alcohol, cannabis, or any impairing substance
  • Carrying a passenger unless expressly approved in writing at booking
  • Using the Vehicle for delivery services, ride-for-hire, instruction, or any commercial purpose
  • Sub-renting, lending, or allowing anyone other than the named Renter to operate the Vehicle
  • Removing, disabling, or tampering with GPS tracking, security devices, or safety equipment installed on the Vehicle
  • Operating the Vehicle outside the state of New Jersey and neighboring states without prior written approval

Any use of the Vehicle in violation of this section is a material breach of this agreement, and the Renter will be personally responsible for the full cost of repair or replacement without benefit of any deductible cap, plus any towing, storage, legal, or administrative costs Owner incurs as a result.

5. Required Safety Gear

A DOT-compliant helmet is mandatory at all times the Vehicle is in operation — no exceptions. A protective jacket, gloves, and closed-toe/over-the-ankle footwear are strongly recommended. Gear rental can be arranged on request prior to pickup. Owner is not responsible for injuries resulting from inadequate protective gear.

6. Bring Your Own Insurance (BYOI) — Required on Every Booking

Every booking requires the Renter to carry, and have verified, their own personal motorcycle insurance policy covering operation of the Vehicle during the rental period. There is no damage waiver, tiered protection plan, or other Owner-provided coverage available — BYOI is the sole and mandatory protection mechanism for every rental, subject to the following:

  • The Renter must email a copy of their current insurance declarations page to hyanes98@gmail.com at least 24 hours before the scheduled pickup, showing active coverage applicable to operating the Vehicle during the rental period.
  • Owner will manually review the declarations page and approve or deny the BYOI verification. Owner's decision will be communicated to the Renter by email before pickup.
  • If Owner denies the verification, or the Renter has not received an approval by the scheduled pickup time, pickup cannot proceed. The Renter and Owner must agree on a new pickup time once verification is completed; no substitute coverage option is available.
  • An approved BYOI verification does not limit or cap the Renter's financial responsibility for damage, loss, theft, or liability — the Renter's own policy, and its terms, conditions, and exclusions, governs that responsibility in full. Owner makes no representation about whether the Renter's policy will actually cover any given incident.
  • No coverage of any kind applies to damage, loss, theft, or liability arising from any prohibited use listed in Section 4 — in those cases the Renter is responsible for the full repair, replacement, or liability cost with no cap, regardless of what the Renter's insurance covers.
  • The Renter is responsible for mechanical wear-and-tear unrelated to an incident, cosmetic damage from normal use, lost keys/fobs (billed at replacement cost), and citations/tolls (see Section 8), none of which is affected by the Renter's insurance.
  • The Renter authorizes Owner to charge the payment method on file for any amount owed under this section that is not covered by the Renter's insurance.

6a. Refundable Security Deposit

A $1,000 refundable security deposit is authorized/collected at checkout alongside the rental payment on every booking, once BYOI has been verified and approved under Section 6. The deposit serves as a hold against amounts owed under this agreement (e.g., uncovered damage, late fees, citations). Absent any damage or amounts owed, the deposit is refunded to the original payment method within 5 business days of the Vehicle being returned and inspected, less any amounts properly owed under this agreement.

7. Vehicle Inspection & Condition Reporting

Owner and Renter will jointly inspect the Vehicle and document its condition (including photos/video) immediately before pickup and immediately upon return. Any damage not noted at pickup is presumed to have occurred during the rental period and is the Renter's responsibility under Section 6. The Renter must report any accident, damage, mechanical issue, or theft to Owner immediately and, where applicable, to local police, regardless of severity.

8. Traffic Violations, Tolls & Citations

The Renter is solely responsible for all traffic violations, parking tickets, tolls, red-light/speed camera citations, and any associated fees issued during the rental period, whether received during the rental or billed afterward. Owner may pass through any such citation received after return, plus a $25 administrative processing fee per citation.

9. Cancellations & Refunds

Bookings are paid in full at the time of request. If Owner cannot accommodate the requested dates, the Renter receives a full refund. Renter-initiated cancellations made more than 48 hours before the scheduled pickup receive a full refund; cancellations inside 48 hours of pickup are refunded at Owner's discretion and may be subject to a partial cancellation fee to cover held availability.

10. Assumption of Risk & Release of Liability

Motorcycling carries inherent risks of injury or death. By signing this agreement, the Renter voluntarily assumes all risks associated with operating the Vehicle and releases Owner, to the fullest extent permitted by New Jersey law, from any claim for personal injury, death, or property damage arising from the Renter's use of the Vehicle, except to the extent caused by Owner's gross negligence or willful misconduct. The Renter agrees to indemnify and hold Owner harmless from third-party claims arising from the Renter's operation of the Vehicle during the rental period.

11. Vehicle Condition Disclaimer

Owner represents that the Vehicle is maintained on a regular service schedule and is roadworthy at the start of each rental. Owner makes no other warranties, express or implied, regarding the Vehicle's fitness for a particular purpose beyond ordinary street use disclosed on this site.

12. Governing Law

This agreement is governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute arising from this agreement will be resolved in the state or federal courts located in New Jersey.

13. Acceptance

Checking "I have read and agree to the Rental Agreement" during booking, followed by completing payment, constitutes the Renter's electronic signature and full acceptance of this agreement, equivalent to a handwritten signature under the New Jersey Uniform Electronic Transactions Act. Owner retains a timestamped record of this acceptance with each booking.
